Welcome to The Leaderboard! We want to ensure that you understand our basic terms of use. You must be at least 18 years old to make any purchases or use our services. Please keep in mind that all purchases are final and non-refundable. By using our app, you agree to follow these guidelines and enjoy a straightforward experience.

Welcome to The Leader Board, a mobile application (“App”) operated by Lezmin 1635 cc, a company registered in Durban, South Africa (“we,” “us,” or “our”). These Terms of Use (“Terms”) govern your access to and use of the App, available globally via the Apple App Store and Google Play Store.
By downloading, registering for, or using the App, you agree to be legally bound by these Terms and our Privacy Policy. If you do not agree, do not use the App.
1. Eligibility
To use The Leader Board, you must:
- Be at least 18 years old
- Have the legal capacity to enter a binding agreement
- Comply with these Terms and our Privacy Policy
We may deny access to anyone previously suspended, terminated, or found to violate these Terms, at our sole discretion.
2. Nature of the Service
The Leader Board is a gamified entertainment platform where users spend real money via in-app purchases to climb public leaderboards based on cumulative spending. This App is not a game of skill or chance. It is a self-expression platform where your spend is a public performance. Key disclosures:
- Spending grants visibility and leaderboard ranking only, not tangible goods, services, or rewards.
- All purchases are voluntary and strictly non-refunded (see Section 4).
- All registered users’ usernames, leaderboard ranks, spending amounts (in aggregated form), bios (for Top 10), linked social media accounts, and profile pictures are publicly visible, with no opt-out (see Section 3).
- The App includes a free raffle system where users earn tickets via daily spins for a chance to win cash prizes, with no purchase required (see Section 5).
- An affiliate system allows users to share creator codes to earn revenue shares, paid manually upon reaching a minimum threshold (see Section 6).
- There are no advertisements or in-app rewards beyond leaderboard status and free raffle eligibility.
Your participation is for entertainment and status, not financial gain.
3. User Accounts and Profiles
- Registration: You must provide accurate, up-to-date information (e.g., username, email) and confirm you are 18+. We may request ID verification to enforce this.
- Single Account: Creating multiple accounts without our prior written approval is prohibited.
- Security: You are responsible for securing your login credentials and all activity under your account.
- Public Visibility: Your username, leaderboard rank, spending amounts (in aggregated form), bio (for Top 10 users), linked social media accounts, and profile picture are publicly visible to all users. This is a mandatory, non-negotiable feature for all registered users. To avoid public visibility, you must not register or use the App.
- Content Standards: Usernames, bios, and profile pictures must not contain harmful, offensive, discriminatory, or illegal content (see Section 7).
Misuse: Account misuse (e.g., false information, unauthorized access) may result in suspension or termination.
4. Spending, Payments, and No-Refund Policy
- In-App Purchases: All payments are processed via in-app purchases through Apple App Store or Google Play Store, subject to their terms and privacy policies.
- Voluntary Spending: You acknowledge that spending is voluntary, solely for leaderboard visibility, with no tangible goods or services provided.
- Strict No-Refund Policy: All in-app purchases are final and non-refunded under any circumstances, including dissatisfaction, change of mind, or leaderboard outcomes, except where mandated by applicable law (e.g., South Africa’s Consumer Protection Act for defective services or statutory rights in certain jurisdictions).
- Payment Responsibility: You are responsible for all charges incurred under your account, including unauthorized use if you fail to secure your credentials.
Third-Party Terms: Apple and Google’s payment terms apply to all transactions.
5. Raffle System
The App includes a free raffle system where users earn tickets through daily spins for a chance to win cash prizes. Key rules:
- Participation is entirely free, voluntary, and does not require in-app purchases.
- Raffle tickets are awarded solely via daily spins, not through spending.
- Raffle odds are based on the number of tickets held by participants and are not influenced by total spend or affiliate activity.
- Cash prizes are set at our discretion and paid manually by the raffle end date, as stipulated in the App.
- Outcomes are random and comply with South Africa’s Lotteries Act and other applicable laws.
- We reserve the right to modify or cancel raffles at any time without liability.
- Cash prizes may be subject to tax or legal requirements in your jurisdiction, for which you are responsible.
This system is not gambling. If you have concerns, contact us or refrain from participating.
6. Affiliate System
- Creator Codes: You may share a unique affiliate/creator code to refer new users. Successful referrals may earn you a revenue share, as determined by us.
- Payouts: Revenue shares are paid manually when you reach a minimum threshold (as specified in the App) and choose to withdraw.
- Tracking: We track referral counts and aggregated spending via your code for leaderboard rankings and revenue calculations. Personal data (e.g., name, email) is not shared with affiliates.
- Responsibility: You must not misrepresent the App or use fraudulent methods (e.g., bots, fake referrals, spamming) to promote your code. Violations may result in revenue forfeiture and account termination.
Modifications: We may adjust revenue share rates, minimum thresholds, or program terms at our discretion, with notice via the App.
7. Code of Conduct
You agree not to:
- Misrepresent your identity or impersonate others
- Post harmful, offensive, discriminatory, defamatory, or illegal content in usernames, bios, profile pictures, or linked social media (e.g., hate speech, explicit material, unlawful references)
- Use bots, exploits, or fraudulent methods to manipulate rankings, raffles, or affiliates
- Harass, threaten, or abuse other users
- Promote third-party services without our written consent
- Attempt to hack, reverse engineer, or disrupt the App
We reserve the right to moderate, edit, or remove any usernames, bios, or profile pictures deemed harmful or in violation of these Terms, at our sole discretion.
8. Moderation and Enforcement
We may monitor App activity to ensure compliance and integrity, including:
- Validating spend-based rankings for accuracy
- Detecting fraudulent accounts or transactions (e.g., chargeback attempts, multi-accounting, fake referrals)
- Reviewing usernames, bios, profile pictures, and linked social media for harmful, offensive, discriminatory, or illegal content
- Ensuring compliance with raffle and affiliate program rules
Violations may result in:
- Warnings issued via email or in-app notification
- Removal of harmful usernames, bios, or profile pictures
- Temporary suspension of account access or features (e.g., leaderboard, raffles)
- Permanent account termination, including forfeiture of leaderboard rankings, raffle tickets, and affiliate revenue
- Reporting to authorities for illegal activity (e.g., fraud, hacking)
We may act with or without notice, depending on the severity of the violation. You may appeal suspensions, terminations, or content removals by contacting help@theleaderboard.site within 14 days, providing evidence to support your case. Our decision is final, but we will review appeals fairly.
9. Intellectual Property
- Ownership: All App content, code, branding, and functionality are owned by Lezmin 1635 cc or our licensors, protected by South African and international copyright laws.
- Restrictions: You may not copy, modify, reverse engineer, or extract App content for commercial use without written permission.
- User Content: You grant us a non-exclusive, royalty-free, worldwide license to use, display, and store your user-generated content (e.g., usernames, bios, profile pictures, linked social media) for App operation.
Feedback: Any feedback you provide may be used freely without compensation.
10. Data Collection and Privacy
Your personal data (e.g., username, email, spending history) is processed per our Privacy Policy. By using the App, you consent to:
- Public display of your username, leaderboard rank, spending amounts, bio (if applicable), profile picture, and linked social media
- Data storage/processing in South Africa and other regions (e.g., Pakistan, USA) for hosting or payment processing
- Collection of device and usage data for analytics and security
11. Disclaimers
The App is provided “as is” and “as available.” We do not guarantee:
- Error-free or uninterrupted operation
- Real-time or accurate leaderboard rankings
- Specific outcomes from spending (e.g., recognition, raffle wins)
We disclaim liability for:
- Platform outages or data loss
- Unauthorized account access due to your failure to secure credentials
- Psychological, reputational, or financial effects from leaderboard visibility
- User-submitted content or actions
12. Limitation of Liability
To the fullest extent permitted by law:
- We are not liable for indirect, incidental, consequential, or punitive damages (e.g., loss of reputation, emotional distress).
- Our total liability for any claim is limited to your total in-app spend in the past 6 months.
- Your sole remedy for dissatisfaction is to stop using the App.
13. Indemnification
You agree to indemnify and hold harmless Lezmin 1635 cc, its affiliates, employees, and partners from claims, damages, or legal actions arising from:
- Your use or misuse of the App
- Violation of these Terms
- Infringement of third-party rights (e.g., intellectual property, privacy)
14. Termination
We may suspend or terminate your access without notice if you:
- Violate these Terms
- Engage in fraud, abuse, or illegal activity (e.g., chargeback attempts, multi-accounting)
- Are inactive for 12 months
- Are subject to a court or regulatory order
Upon termination, your account, rankings, raffle tickets, and affiliate revenue may be deleted without recovery. Provisions surviving termination (e.g., Sections 9, 11, 12, 13) remain in effect.
15. Force Majeure
We are not liable for delays or failures in App performance due to events beyond our control, including natural disasters, server outages, or third-party payment processor issues.
16. Dispute Resolution
- Informal Resolution: Contact help@theleaderboard.site to resolve disputes informally within 30 days before escalating.
- Governing Law: These Terms are governed by South African law, without regard to conflict of law rules.
- Jurisdiction: Disputes must be resolved in courts located in Durban, South Africa. You waive jurisdictional objections if outside South Africa.
Consumer Rights: If you are in the EU or another jurisdiction with mandatory consumer protections, you may retain rights under local laws (e.g., GDPR, EU Consumer Rights Directive).
17. International Users
The App may not be lawful or accessible in all regions. By using it outside South Africa, you are responsible for compliance with local laws, including age and consumer regulations.
18. Changes to These Terms
We may update these Terms at any time. Material changes will be notified via in-app announcements, email, or a prominent notice at least 7 days before taking effect. Continued use after updates constitutes acceptance.
